Acceptance of terms
By using this website you accept these Terms of Service. We may update them from time to time without notice, and any guidelines posted for a specific service form part of these terms.
The service
IndiaSquare provides community information and communication tools, including classifieds, a business directory, festival information and online forms. The service is provided “as is”. You are responsible for your own internet access and equipment. You must be 18 or older to post on message boards or classifieds.
Your conduct
You are solely responsible for anything you post or send. Do not post content that is unlawful, harassing, defamatory, hateful, misleading or that infringes anyone’s rights; do not impersonate others, send spam or malware, disrupt the service or collect other users’ personal data. We do not pre-screen content but may remove or move any content at our discretion, and may preserve or disclose content where the law requires it or to protect our users, the public or our rights.
Content you post publicly
When you post content in public areas (for example a classified ad or business listing) you grant IndiaSquare a royalty-free, perpetual, non-exclusive licence to use, display and distribute it in connection with the service.
Indemnity
You agree to hold IndiaSquare, JCAMA and their partners harmless from third-party claims arising from content you submit or your use of the service.
No resale
You may not copy, resell or commercially exploit any part of the service without written permission.
Limits, changes and termination
We may set limits on storage and usage, change or discontinue any part of the service, and suspend or close accounts that are inactive or violate these terms. Certain provisions (including liability limits, indemnity and governing law) survive termination.
Advertisers and links
Dealings with advertisers, sponsors and businesses listed on the site are solely between you and them. We are not responsible for third-party websites or their content.
Proprietary rights
The site, its design and software are protected. You receive a limited personal licence to use them and may not modify, reverse engineer or access the service by unauthorised means.
Disclaimer and limitation of liability
The service is provided “as is” and “as available” without warranties of any kind. To the extent permitted by law, IndiaSquare is not liable for indirect, incidental, special or consequential damages arising from your use of the service. Some jurisdictions do not allow these exclusions, so some may not apply to you.
Copyright complaints
To report copyright infringement, contact us with your signature, a description of the work and the infringing material, your contact details, a good-faith statement and a statement under penalty of perjury that your notice is accurate.
Governing law
These terms are governed by the laws of the State of New Jersey. Disputes will be resolved in the state and federal courts of New Jersey. Any claim must be brought within one year of arising.
Privacy policy
Information we collect
Your IP address and browser type (for diagnostics and aggregate statistics); cookies for sessions and preferences; and the details you choose to send us through forms — contact, donation, registration, sponsorship, classifieds, business listing and call-back requests.
How we use it
To answer your request, run the festival, publish listings you submit, send receipts and confirmations, and improve the site. Aggregate, non-identifying statistics may be shared with sponsors and partners. We do not sell your personal information.
Children
We do not knowingly collect personal information from children under 13 without verifiable parental consent.
Your choices
You can opt out of communications at any time and ask us to update or delete the information you have submitted by contacting us.
Private messages
Messages you send through the site are not read or disclosed except under valid legal process, to protect rights or property, or in an emergency.
Third-party services
Embedded videos (YouTube, Vimeo, Facebook), maps, WhatsApp and payment providers have their own privacy policies.
